Bazzurini S.r.l. Via G.Donizetti 14 25046 Cazzago SM (BS) Italy, represented by Ruggenthaler, Rest & Borsky Rechtsanwälte OG undertakes to the Verein für Konsumenteninformation, Linke Wienzeile 18, A-1060 Wien represented by the Kosesnik-Wehrle & Langer Rechtsanwälte KG.

Firstly, in commercial transactions with Austrian consumers in general terms and conditions which it bases on the contracts concluded with it and/or in the contract forms used in this connection, the use of the following clauses:

  1. By browsing and submitting an order on the Site, you accept the terms and conditions and privacy policies adopted by the Site indicated therein.
  2. These General Conditions of Sale apply to the sale of products with exclusive reference to purchases made on the website in accordance with the provisions of Part III, Title III, Chapter I, Consumer Code (Legislative Decree no. 206/05, amended by Legislative Decree no. 21/14 and Legislative Decree 70/03) of the company: BAZZURINI S.r.l. with registered office in: Via G.Donizetti, 14 - 25046 CAZZAGO SM (BS) […] here in after referred to as: Shopdecor
  3. We invite the user to download and print a copy of the purchase form and these General Conditions of Sale, the terms of which Shopdecor reserves the right to modify unilaterally and without prior notice.
  4. In any case, the confirmation releases Shopdecor from any responsibility regarding the data provided by the user.
  5. Upon the User's first request to activate a profile, Shopdecor will assign a username and password to that profile. Shopdecor acknowledges that these identifiers constitute the system for validating the User's access to the Services and the only system capable of identifying the User, and that the actions performed through such access are attributed to and binding upon the User.
  6. Product availability refers to the actual availability at the time the user places the order. However, this availability should only be considered indicative, as the products may be sold to other customers prior to order confirmation due to the simultaneous presence of multiple users on the website.
  7. Even after the order confirmation email has been sent, cases of partial or total unavailability of the product may occur. In this case, the order will be automatically corrected by canceling the unavailable product, and the user will be notified immediately in writing via email.
  8. If, after this notification, the User requests cancellation of the order by terminating the contract, Shopdecor will refund the total amount paid within 14 days from the date on which Shopdecor became aware of the Buyer's decision to terminate the contract.
  9. The price of the Products shall be the price stated on the Website from time to time, unless there is an obvious error.
  10. In the event of an error, Shopdecor will notify the buyer as soon as possible to confirm the order with the correct amount or cancel it. In any case, Shopdecor is not obliged to deliver what was sold at the incorrectly stated lower price. The refund will be made in the manner provided for in Article 5, paragraph 3 of this section of the General Terms and Conditions of Sale.
  11. Delivery is generally within 30 days, or, if no delivery date is specified in the order confirmation, within the estimated delivery time indicated on the product page and when selecting the delivery method at checkout. In the event of unexpected delivery delays, Shopdecor will notify the customer so that they can choose whether to accept the extension or request cancellation of the order, which will terminate the contract.
  12. In the event that the customer cannot be present at the delivery location on the date and time communicated by the carrier, the customer must contact the carrier again to arrange a new delivery date. In the event that the customer has difficulty returning the order, we recommend contacting Shopdecor Customer Service to avoid warehouse closure and return of the order to the Shopdecor warehouse, who will assist you with the carrier.
  13. If, for reasons beyond Shopdecor's control, delivery cannot be made after thirty days from the date on which the order is ready for delivery, we will assume that there is an intention to terminate the contract.
  14. Following termination, the amounts paid, including delivery costs, with the exception of any additional costs resulting from choosing a delivery method other than the one normally offered, will be refunded promptly and in any event within 14 days of the delivery date. Termination of the contract. Transport resulting from the termination of the contract may incur additional costs, which will be borne by the buyer.
  15. The risks associated with the Products pass to the Buyer upon delivery. Ownership of the Products shall be deemed acquired upon receipt of full payment of all amounts due, including shipping costs, or upon delivery, if later.
  16. Shopdecor is liable for any defects in the products offered on the Site, including any non-conformity of the items with those ordered, in accordance with the provisions of Italian law. If the Buyer has concluded the contract as a consumer, that is, as a natural person acting on the Site for purposes unrelated to a commercial or professional activity, this guarantee is valid on the condition: - that the Buyer submits a formal complaint within a maximum of 2 months from the date on which the defect was detected by the latter; - that it is correctly communicated by email to Customer Service at the address: info2@shopdecor.com
  17. In accordance with the applicable legal provisions, the Buyer has the right to withdraw, without penalty and without giving any reason, within a period of 14 (fourteen) days pursuant to Art. 57 of Legislative Decree no. 206/2005 from the date of delivery of the Products.
  18. The user who intends to exercise the right of withdrawal from the purchase can send an email with the name of the buyer, the number and the date of the order to the address: info2@shopdecor.com
  19. The buyer must also exercise the right of withdrawal by sending an express declaration containing the decision to withdraw from the contract or, alternatively, by sending the standard withdrawal form in accordance with Annex I, Part B, Legislative Decree 21/2014 (not required).
  20. The right of withdrawal does not apply if the services and/or products purchased from Shopdecor fall within the categories of art, as defined by Article 59 of Legislative Decree 206/2005.
  21. The Buyer's data will be processed in accordance with the provisions of the legislation on the protection of personal data, as indicated in the relevant section containing the information pursuant to Article 13 of Regulation 2016/679 of the European Union (Data Protection Directive).
  22. These General Terms and Conditions of Sale are governed by and construed in accordance with Italian law, without prejudice to any other mandatory provisions of the country of the Buyer's habitual residence. Consequently, the interpretation, execution, and termination of these General Terms and Conditions of Sale are governed exclusively by Italian law.
  23. In the event that the purchased product has manufacturing defects or does not meet the ordered specifications, we undertake to replace the product under warranty and at no additional cost. In the case of manufacturing defects, it is necessary that you send us photographic documentation of the defective product so that we can assess the problem and possibly forward the images to the manufacturer.
  24. To exercise this right, it is necessary within 14 days from the date of receipt of the goods contact us indicating the references to the order, the details of the faulty and/or non-compliant product. Our customer service will contact you as soon as possible to solve the problem and we will make the replacement as soon as possible at the same address used for the previous delivery, except in case of unavailability or cessation of production of the product itself. In the event of such a situation, ShopDecor will refund the price of the product. The return must be made within 14 days of the authorization date.
  25. If upon delivery you find that the packaging is not intact, damaged, wet or otherwise altered, we ask you to immediately write the phrase:" GOODS INSPECTION RESERVE "On the courier waybill, reporting on the same label, in detail the damage suffered during transportation.
  26. Once you have received the goods and after noticing any transport damage, we ask you to notify us as soon as possible and in any event within 14 (fourteen) days of receipt of the goods: Contact us stating in the email, the order references and details of the damaged goods.
  27. It is necessary that you send us photographic documentation of the received packaging and the damaged goods so that we can verify the extent of the damage to the products.
  28. If the courier's document is signed without affixing "RESERVE", unfortunately you will not be able to object to the damage found on the products.
  29. Once the return is approved, we will send you the carrier's prepaid label so you can return the damaged product to us free of charge. Packages returned via cash on delivery without the prepaid label we sent will not be accepted.
  30. The return must be made within 14 days of the date of approval.
  31. Important: Returns must be in the original packaging and must always be authorized in advance by ShopDecor customer service.
  32. Pursuant to Articles 55 and following of Legislative Decree no. 206 of September 6, 2005, you have 14 days from receipt of your order to exercise your right of withdrawal and request the total or partial return of your order. This right does not apply to custom-made or personalized products or those that, by their nature, cannot be returned.
  33. Please remember that the goods must be returned undamaged and in their original packaging.
  34. The return must be made within 14 days of the date of approval.

secondly, to publish points one and two of this settlement on its website https://shopdecor.com/de for a period of 30 days, accessible via a conspicuous and unmistakable link on the homepage with the text "Settlement with the VKI", which leads to a subpage where the settlement text is displayed in black font on a white background with the heading "Settlement" in bold and the names of the parties in bold, otherwise in normal font as used on the website for general terms and conditions;
